

Long Term Care and Medicaid Planning
New York Law is becoming more strict with Medicaid eligibility. Long-term Medicaid (both In-Facility
and In-Community) often imposes a period of ineligibility if the applicant has made transfers of assets
in order to qualify (often referred to as the “lookback period”). The duration of the period of ineligibility
is dependent on the type of long-term care being sought. Failing to account for the applicable
look-back period can devastate a family’s savings due to the extremely high cost of services.
As part of the application process, we will evaluate any transfers made during the applicable lookback
period and advise you as to the best method to minimize or possibly avoid any period of
ineligibility. We will also coordinate all submissions to the Department of Social Services (DSS) and/or
care providers, up to and including the applicant’s approval.
